Welcome to Evergreen Decorations Kerala. These Terms and Conditions govern your use of our event decoration and catering services across Kerala, India. By booking or using our services, you agree to be bound by these terms.

Evergreen Decorations Kerala is a professional event decoration company specializing in weddings, birthdays, anniversaries, baby showers, housewarmings, corporate events, and destination weddings. We also provide comprehensive catering services.

Important: Please read these terms carefully before booking our services. If you do not agree with any part of these terms, you should not proceed with booking our services.

Definitions

In these Terms and Conditions, the following terms have the meanings specified below:

  • "Company" refers to Evergreen Decorations Kerala, the service provider.
  • "Client" refers to the individual or entity booking our services.
  • "Services" refers to all decoration and catering services provided by the Company.
  • "Event" refers to the wedding, birthday, anniversary, or other celebration being decorated.
  • "Venue" refers to the location where the Event will take place.
  • "Decoration Materials" refers to all floral arrangements, fabrics, lighting, furniture, and other decorative items.
  • "Catering Services" refers to food preparation, service, and related activities.

Booking and Confirmation Policy

Booking Process

To book our services, clients must:

  • Contact us through our website, phone, or email to inquire about available dates
  • Provide event details including date, venue, type of event, and estimated guest count
  • Schedule a consultation meeting (in-person or virtual) to discuss decoration requirements
  • Receive and review a detailed quotation outlining services and costs
  • Sign the service agreement and pay the advance payment to confirm booking

Confirmation Requirements

Booking Confirmation: Your booking is only confirmed upon receipt of the advance payment and signed service agreement. Date availability is not guaranteed until confirmation is complete.

We reserve the right to release unconfirmed bookings after 7 days of initial inquiry if no confirmation is received.

Advance Payment Terms

Advance Payment Requirements

  • Percentage: 30% of the total quoted amount must be paid as advance payment to confirm booking
  • Timing: Advance payment must be made within 7 days of quotation acceptance
  • Coverage: Advance payment covers initial planning, design consultation, material sourcing, and date reservation

Payment Methods

Advance payment can be made through:

  • Bank Transfer (NEFT/RTGS)
  • UPI Payments
  • Online Payment Gateway
  • Cash (with proper receipt)
  • Credit/Debit Card
Note: All payments are non-refundable except as specified in the Cancellation and Refund Policy. Advance payment is mandatory for booking confirmation.

Final Payment Terms

Final Payment Schedule

  • Percentage: Remaining 70% of the total amount is due as final payment
  • Timing: Final payment must be completed before the event starts or as mutually agreed in the service agreement
  • For Corporate Events: Final payment may be due 7 days before the event as specified in the contract

Payment Consequences

Critical: Services will not commence until final payment is received. We reserve the right to delay or not proceed with decoration setup if final payment is not made as agreed.
  • Decoration setup will begin only after final payment confirmation
  • Catering services require final payment before food preparation begins
  • Late payment may result in service delays or additional charges
  • All payments must be made in Indian Rupees (INR)

Cancellation and Refund Policy

Client Cancellation

If the Client cancels the booking, refunds will be processed as follows:

Company Cancellation

If Evergreen Decorations Kerala must cancel due to circumstances beyond our control:

  • Full refund of all payments made by the Client
  • Additional compensation as mutually agreed (if applicable)
  • Assistance in finding alternative decoration services (if requested)
Refund Processing: All refunds will be processed within 15-30 business days through the same payment method used by the Client.

Rescheduling Policy

Rescheduling Request

  • Clients may request to reschedule their event to a different date
  • Rescheduling requests must be made at least 30 days before the original event date
  • New date must be available and confirmed by the Company
  • Rescheduling is subject to availability of our team and materials

Rescheduling Charges

Rescheduling Fee: A fee of ₹5,000 or 5% of the total amount (whichever is higher) applies for rescheduling requests.
  • Rescheduling within 30 days of original event: ₹10,000 or 10% of total amount
  • Rescheduling within 15 days of original event: Not permitted except in extraordinary circumstances
  • Price changes may apply if new date has different material/labor costs

Only one free rescheduling is allowed. Additional reschedulings incur full charges.

Client Responsibilities

Clients are responsible for the following to ensure successful event execution:

Pre-Event Responsibilities

  • Provide accurate event details (date, time, venue, guest count, theme preferences)
  • Make timely payments as specified in the payment schedule
  • Communicate changes or special requirements at least 14 days before the event
  • Confirm final guest count 7 days before the event (especially for catering)
  • Obtain necessary permissions from venue management

During Event Responsibilities

  • Ensure venue is accessible as per agreed schedule
  • Provide adequate power supply and water access for our team
  • Coordinate with venue staff for our team's entry and setup
  • Supervise guest behavior to prevent damage to decoration materials
  • Report any issues immediately to our event coordinator

Venue Access Requirements

Access Schedule

  • Clients must ensure venue access for decoration setup as per agreed timeline
  • Standard Setup Time: 12-24 hours before event start (varies by event type)
  • Large Events: Up to 36 hours setup time may be required
  • Destination Weddings: Multiple days access required as specified in contract

Venue Requirements

Mandatory: Venue must provide adequate space, power supply (minimum 15-20 amps), water access, and secure storage for materials.
  • Unobstructed access for vehicle entry and material transport
  • Proper flooring that can support decoration structures
  • Availability of electrical points for lighting and equipment
  • Security for materials during setup and event duration
  • Permission for any structural modifications (hanging decorations, etc.)

If venue access is delayed or restricted, additional charges may apply for extended setup time.

Decoration Setup and Dismantling

Setup Process

  • Our team will arrive at the scheduled time for decoration setup
  • Setup includes all decoration materials, lighting, furniture arrangement, and floral arrangements
  • Final inspection with Client before event start to ensure satisfaction
  • Minor adjustments may be made during the event if requested

Dismantling Process

  • Decoration dismantling begins after event completion
  • Standard Removal: All materials removed within 4-8 hours after event ends
  • Floral Items: Fresh flowers may be removed immediately; artificial flowers removed within standard timeframe
  • Client must specify if they want to keep any decoration items (subject to additional charges)
  • Venue must be left in clean condition; we remove all decoration-related waste
Important: Dismantling must be completed within the agreed timeframe. Extended dismantling time incurs additional charges of ₹2,000 per hour.

Floral and Material Availability

Floral Availability

Evergreen Decorations Kerala guarantees premium quality flowers, but availability is subject to:

  • Seasonal availability of specific flower varieties
  • Market conditions and weather affecting supply
  • Quantity required for the event size
Substitution Policy: If requested flowers are unavailable, we will substitute with similar quality and color flowers of equal or better value without additional charges.

Material Availability

  • All decoration materials (fabrics, lighting, furniture) are subject to availability
  • We maintain a large inventory but cannot guarantee specific items for all dates
  • Alternative materials of equal quality will be provided if requested items are unavailable
  • Rare or custom items must be confirmed 30 days before event

Client approval is required before any substitutions are made.

Weather and Force Majeure Conditions

Weather Conditions

For outdoor events, weather is a critical factor:

  • Client must provide weather-appropriate backup arrangements (tents, indoor space)
  • Extreme weather (heavy rain, storms, extreme heat) may require decoration modifications
  • Weather-related changes must be communicated immediately to our team
  • Additional charges may apply for weather protection measures

Force Majeure

Force Majeure Events: Neither party is liable for failure to perform due to circumstances beyond reasonable control, including natural disasters, government restrictions, pandemics, war, or extreme weather.
  • In case of force majeure, booking may be rescheduled without charges
  • If rescheduling is not possible, refund policy applies as per cancellation terms
  • Both parties will work cooperatively to find alternative solutions
  • Documentation of force majeure event may be required

Kerala's monsoon season (June-September) requires special planning for outdoor events.

Photography and Portfolio Usage Rights

Company Photography Rights

Evergreen Decorations Kerala retains the right to:

  • Photograph and video record all decoration work for portfolio purposes
  • Use event images on our website, social media, marketing materials, and promotional content
  • Submit work to industry publications and award competitions
  • Showcase decorations in future client consultations

Client Privacy Options

Privacy Request: If Clients prefer not to have their event photographed or used in portfolio, they must inform us before booking confirmation. Privacy requests may affect service pricing.
  • Clients may request restrictions on specific areas being photographed
  • Guest privacy must be respected; no close-up shots of guests without consent
  • Company will not share images that reveal Client's personal information without consent

Client Photography

Clients and their guests are free to photograph the event for personal use. Professional photographers hired by Clients must coordinate with our team for setup access.

Catering Service Terms

Menu and Services

  • Menu is finalized 14 days before the event
  • Guest count must be confirmed 7 days before event (final guarantee)
  • vegetarian, vegan, and special dietary options available upon request
  • Food quality and safety standards comply with Kerala Food Safety Regulations

Service Requirements

Minimum Guarantee: Client must guarantee minimum guest count. Food will be prepared for guaranteed count + 10%. Charges apply for guaranteed count regardless of actual attendance.
  • Catering staff arrive 2 hours before serving time
  • Service includes food preparation, serving, and cleanup
  • Beverage services include water, soft drinks, and specified beverages
  • Alcohol service requires valid license and additional charges

Additional Charges

  • Extra guests beyond guaranteed count: Per plate charge applies
  • Extended service hours: ₹3,000 per hour for staff
  • Special menu items: Subject to quotation
  • Destination catering: Travel charges apply

Third-Party Vendor Responsibilities

Client-Hired Vendors

Clients may hire third-party vendors (photographers, musicians, artists, etc.):

  • Client is responsible for coordinating with third-party vendors
  • Third-party vendors must coordinate setup timing with our team
  • Our team is not responsible for third-party vendor performance or delays
  • Any damage caused by third-party vendors to our decorations is Client's responsibility

Company-Recommended Vendors

Recommendation Only: Vendors recommended by Evergreen Decorations Kerala are provided as suggestions only. We do not guarantee their performance and are not liable for their services.
  • Client enters independent agreement with third-party vendors
  • Company facilitates coordination but is not party to vendor contracts
  • Payment disputes with third-party vendors are Client's responsibility

All vendors must adhere to venue rules and decoration setup timelines.

Liability Limitations

Company Liability

Liability Cap: Evergreen Decorations Kerala's total liability is limited to the total amount paid by the Client for our services.
  • We are liable only for direct damages caused by our negligence
  • Not liable for indirect, consequential, or incidental damages
  • Not liable for event cancellation due to factors beyond our control
  • Not liable for guest injuries unless directly caused by our decoration setup

Exclusions

We are NOT liable for:

  • Damage to venue property unless caused by our team's negligence
  • Loss or damage to Client's personal property
  • Emergency situations (medical, security, power failure)
  • Third-party vendor failures or delays
  • Weather-related event disruptions
  • Food-related issues when Client hires separate catering

Client Liability

Client is responsible for:

  • Damage to decoration materials caused by guests or Client
  • Venue damage resulting from event activities
  • Guest injuries not caused by our negligence
  • Security breaches or theft during event

Intellectual Property Rights

Company Intellectual Property

  • All decoration designs, concepts, and creative work are intellectual property of Evergreen Decorations Kerala
  • Clients may not reproduce, copy, or commercialize our decoration designs without permission
  • Company trademarks, logos, and brand names are protected
  • Website content, images, and materials are copyrighted

Client Intellectual Property

Client Rights: Clients retain ownership of their event photos, personal content, and proprietary materials brought to the event.
  • Client may use event photos for personal purposes
  • Client's trademarks or logos used in decoration remain Client's property
  • Company will not use Client's proprietary information without consent

Usage Restrictions

Neither party may:

  • Use the other party's intellectual property without written permission
  • Register similar trademarks or business names
  • Claim ownership of the other party's creative work

Website Usage Terms

Acceptable Use

  • Website is for personal information and service booking purposes only
  • Users must not misuse the website or attempt unauthorized access
  • No illegal, harmful, or fraudulent activities through the website
  • Users must provide accurate information when booking or contacting

Restrictions

Users shall NOT:

  • Attempt to hack, breach security, or access unauthorized areas

  • Manage payments and financial records
  • Send service-related notifications (not marketing without consent)
  • Maintain business records as required by law

Data Protection

  • We implement security measures to protect Client data
  • Data is not shared with third parties without consent (except necessary service providers)
  • Clients may request data access, correction, or deletion
  • Data is retained for 7 years for legal and business purposes

Governing Law (Kerala, India)

Legal Jurisdiction

These Terms and Conditions are governed by and construed in accordance with:

  • Laws of the State of Kerala, India
  • Laws of the Republic of India

Dispute Resolution

Resolution Process: Any disputes arising from these terms will be resolved through the following process:
  • Step 1: Good faith negotiation between parties (30 days)
  • Step 2: If negotiation fails, mediation through Kerala State Mediation Center
  • Step 3: If mediation fails, legal proceedings in courts of Kerala, India

Legal Requirements

  • All transactions comply with Indian Contract Act, 1872
  • Payment terms comply with Reserve Bank of India regulations
  • Catering services comply with Kerala Food Safety Regulations
  • Business operations comply with applicable Kerala state laws

Both parties agree to submit to the exclusive jurisdiction of courts in Kerala, India.

Changes to Terms

Modification Rights

  • Evergreen Decorations Kerala may modify these Terms and Conditions at any time
  • Changes will be posted on our website with updated effective date
  • Material changes will be communicated to Clients via email or phone
  • Continued use of services after changes constitutes acceptance of new terms

Effective Date

Current Version: These Terms are effective as of June 1, 2026. Previous versions are superseded.
  • Terms apply to all bookings made after the effective date
  • Existing bookings remain governed by terms agreed at booking time
  • Clients may request current version of Terms at any time

Client Acceptance

By booking services, Clients confirm:

  • They have read and understood these Terms and Conditions
  • They accept all terms without modification
  • They have authority to bind themselves or their organization to these terms
  • They understand key provisions (payment, cancellation, liability)
